Custody

There are two types of custody in Pennsylvania; legal custody and physical custody. Legal custody refers to making important decisions for a child such as educational, religious, and medical decisions. Physical custody refers to where the child physically resides. There are three types of physical custody: primary, shared, and partial.

It is often difficult for parents living in separate homes to determine an appropriate custody arrangement for the children. In Pennsylvania, custody determinations are to be made using a best interest of the child standard. The goal for many individuals involved in a custody dispute is to create a workable, flexible schedule which fosters loving and caring relationships between both parents and the children.

The procedure in a custody matter varies from county to county. Local county rules dictate the manner in which your custody matter is to proceed. In Pennsylvania, custody determinations are to be made in a prompt manner. Prior to the time of a custody trial, you may be able to request the Court grant interim relief outlining a temporary custody schedule.
